{"id":1755,"date":"2025-06-06T16:03:31","date_gmt":"2025-06-06T19:03:31","guid":{"rendered":"https:\/\/giovannamodena.com.br\/?p=1755"},"modified":"2025-06-09T15:22:10","modified_gmt":"2025-06-09T18:22:10","slug":"rescisao-indireta-no-direito-do-trabalho","status":"publish","type":"post","link":"https:\/\/giovannamodena.com.br\/?p=1755","title":{"rendered":"Rescis\u00e3o Indireta no Direito do Trabalho"},"content":{"rendered":"\n<p>A rescis\u00e3o indireta \u00e9 uma modalidade de t\u00e9rmino do contrato de trabalho prevista na Consolida\u00e7\u00e3o das Leis do Trabalho (CLT), caracterizada pela iniciativa do empregado diante de faltas graves cometidas pelo empregador. Trata-se de uma forma de rescis\u00e3o por justa causa aplicada ao empregador, conferindo ao trabalhador o direito de encerrar o v\u00ednculo empregat\u00edcio sem preju\u00edzo das verbas rescis\u00f3rias a que teria direito em caso de dispensa sem justa causa.<\/p>\n\n\n\n<p>Essa possibilidade est\u00e1 prevista no artigo 483 da CLT, que elenca as hip\u00f3teses em que o empregado poder\u00e1 considerar rescindido o contrato e pleitear judicialmente os seus direitos.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Hip\u00f3teses de Rescis\u00e3o Indireta<\/strong><\/h3>\n\n\n\n<p>Conforme o artigo 483 da CLT, s\u00e3o motivos que justificam a rescis\u00e3o indireta:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Exig\u00eancia de servi\u00e7os superiores \u00e0s for\u00e7as do empregado, proibidos por lei, contr\u00e1rios aos bons costumes ou alheios ao contrato;<\/li>\n\n\n\n<li>Tratamento com rigor excessivo;<\/li>\n\n\n\n<li>Submiss\u00e3o a perigo manifesto de mal consider\u00e1vel;<\/li>\n\n\n\n<li>Descumprimento das obriga\u00e7\u00f5es contratuais pelo empregador;<\/li>\n\n\n\n<li>Pr\u00e1tica de atos lesivos \u00e0 honra ou \u00e0 reputa\u00e7\u00e3o do empregado, ou de seus familiares;<\/li>\n\n\n\n<li>Agress\u00e3o f\u00edsica, salvo em caso de leg\u00edtima defesa;<\/li>\n\n\n\n<li>Redu\u00e7\u00e3o do trabalho, sem justificativa, que afete sensivelmente a remunera\u00e7\u00e3o do empregado.<\/li>\n<\/ul>\n\n\n\n<p>Essas condutas, quando comprovadas, autorizam o trabalhador a romper o contrato de trabalho de forma unilateral, com respaldo legal, assegurando o recebimento de todas as verbas rescis\u00f3rias, como:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Saldo de sal\u00e1rio;<\/li>\n\n\n\n<li>F\u00e9rias vencidas e proporcionais com adicional de 1\/3;<\/li>\n\n\n\n<li>13\u00ba sal\u00e1rio proporcional;<\/li>\n\n\n\n<li>Multa de 40% do FGTS;<\/li>\n\n\n\n<li>Libera\u00e7\u00e3o do saldo do FGTS;<\/li>\n\n\n\n<li>Acesso ao seguro-desemprego (se preenchidos os requisitos legais).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Procedimento e Import\u00e2ncia da Prova<\/strong><\/h3>\n\n\n\n<p>A rescis\u00e3o indireta requer cautela por parte do empregado, especialmente quanto \u00e0 constitui\u00e7\u00e3o de provas. Como a alega\u00e7\u00e3o de justa causa contra o empregador deve ser fundamentada, \u00e9 essencial reunir <strong>documentos, testemunhas ou qualquer outro meio id\u00f4neo que comprove a conduta faltosa.<\/strong><\/p>\n\n\n\n<p>Na pr\u00e1tica, \u00e9 comum que o empregado continue prestando servi\u00e7os at\u00e9 que haja uma decis\u00e3o judicial que reconhe\u00e7a a rescis\u00e3o indireta. Isso porque, ao se afastar imediatamente do trabalho sem amparo legal, corre-se o risco de caracteriza\u00e7\u00e3o de abandono de emprego.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Jurisprud\u00eancia e Entendimento dos Tribunais<\/strong><\/h3>\n\n\n\n<p>Os tribunais t\u00eam reconhecido com frequ\u00eancia a rescis\u00e3o indireta nos casos em que h\u00e1 descumprimento reiterado das obriga\u00e7\u00f5es contratuais por parte do empregador, como:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>N\u00e3o pagamento de sal\u00e1rios;<\/li>\n\n\n\n<li>Aus\u00eancia de recolhimento do FGTS;<\/li>\n\n\n\n<li>Ass\u00e9dio moral;<\/li>\n\n\n\n<li>Entre outras situa\u00e7\u00f5es comprovadas.<\/li>\n<\/ul>\n\n\n\n<p>No entanto, a an\u00e1lise \u00e9 sempre feita de forma cautelosa, sendo imprescind\u00edvel que o trabalhador comprove de forma objetiva os motivos alegados.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Considera\u00e7\u00f5es finais<\/strong><\/h3>\n\n\n\n<p>A rescis\u00e3o indireta \u00e9 uma importante ferramenta de prote\u00e7\u00e3o ao trabalhador diante de situa\u00e7\u00f5es abusivas ou ilegais praticadas pelo empregador.
